Benjamin McDermott

Benjamin J. McDermott is an associate in the firm's Employment, Labor, Benefits and Immigration Practice Group, where he focuses his practice on business immigration matters. Prior to joining Duane Morris, Benjamin practiced at immigration‑focused law firms, where he advises multinational corporate clients across a wide range of industries, including financial services, banking, financial technology, telecommunications, sports, and civil engineering. His practice encompasses the full spectrum of nonimmigrant visa matters, including E‑1 treaty trader visas, E‑2 treaty investor visas, H‑1B specialty occupation visas, J‑1 waiver applications, L‑1 intracompany transferee visas, O‑1 visas for individuals of extraordinary ability, P‑1 visas for internationally recognized athletes and entertainers, and TN visas for Canadian and Mexican professionals. Benjamin also has significant experience handling both employment‑ and family‑based permanent residence matters, with a primary focus on employment‑based cases. His work includes PERM labor certification applications, immigrant visa petitions, adjustment of status applications, and consular processing. He routinely prepares responses to Requests for Evidence across all visa classifications and guides clients through USCIS and consular proceedings. In addition, Benjamin advises clients on naturalization applications and regularly prepares for and attends USCIS interviews. Across all matters, he provides strategic guidance on compliance and the maintenance of lawful immigration status.
