Daniel D. Spencer

Daniel D. Spencer practices in the area of employment law and litigation. He represents employers in complex disputes, including single-plaintiff claims, wage and hour actions, wrongful termination, discrimination, and other matters arising under California’s Fair Employment and Housing Act. Mr. Spencer has extensive experience defending employers in class actions and representative actions under the Private Attorneys General Act (PAGA), as well as advising on compliance and conducting employment-practices audits to reduce litigation risks.

Mr. Spencer regularly appears in state and federal courts and before administrative agencies, including the National Labor Relations Board, the Equal Employment Opportunity Commission, and state labor and discrimination agencies. He counsels clients on USERRA, ADA, FMLA, wage and hour, and other workplace issues, and provides training on employment law compliance. He also advises clients on union negotiations and unfair labor practice claims.

In addition to his private practice, Mr. Spencer has served in a variety of roles in the U.S. military. He is currently a Civil Affairs Officer with the U.S. Army Reserve and recently deployed to the Middle East in support of Operation Spartan Shield, where he directed civil affairs operations across Kuwait, Saudi Arabia, Oman, and Jordan. He previously served with the California Army National Guard as both a Judge Advocate and Civil Affairs Officer, including as a Rule of Law Advisor in Afghanistan mentoring Afghan National Defense and Security Forces. Earlier in his career, he served on active duty in the United States Marine Corps and deployed to Iraq during Operation Iraqi Freedom. His military awards include the Bronze Star, Meritorious Service Medal, Army Commendation Medal, and Combat Action Ribbon.

Mr. Spencer is admitted to practice in California, Minnesota, the U.S. District Courts for the Northern, Southern, Central and Eastern Districts of California, and the U.S. District Court for the District of Arizona.
