Matt Yungwirth is a seasoned trial attorney who has focused on intellectual property licensing and litigation (district courts, International Trade Commission and Patent Trial and Appeal Board) throughout his 23 year legal career. He primarily serves clients in the wireless communication (cellular, Wi-Fi, BT, etc.), LED lighting and wireless power technology fields; but he also has handled matters involving POE, digital watermarking, metallurgy, VoIP, intelligent I/Os, digital signal processing, digital cable set-top receivers, and bank networking and encryption schemes. In addition to handling the intellectual property needs of his technology clients, Matt also takes an active role in managing several technology focused initiatives at Duane Morris, including serving as a team lead of the firm’s Technology, Media and Telecom industry group; co-chairing the firm’s Partners Technology Committee and leading the firm’s multidisciplinary Artificial Intelligence Steering Committee. Matt is also a member of the firm's governing Partners Board.
Matt’s interest in technology and intellectual property also is reflected in his educational background starting at Georgia Tech, where he graduated with an engineering degree in 1996, and later at the University of Georgia School of Law, where he served as the managing editor of the Journal of Intellectual Property Law, and graduated cum laude in 2000.
Representative Matters
Represented numerous networking infrastructure clients in dozens of patent litigations involving wireless standards (e.g., 802.11, 3GPP, Zigbee) that resulted in voluntary dismissals of the plaintiffs’ claims, judgments of non-infringement affirmed by the Federal Circuit, findings of unpatentability by the PTAB, or settlements advantageous to the clients.
Represented largest commercial lighting company in the United States in connection with LED and wireless networking patent district court cases and three ITC investigations, which were resolved through voluntary dismissals or license agreements advantageous to client.
Represented large U.S.-based semiconductor company in ITC investigation involving field effect transistors used in semiconductors for smartphones and televisions, which was resolved through settlement.
Represented Fortune 100 computer networking company in numerous patent litigation matters related to (i) Voice over Internet Protocol (VoIP) technology that resulted in an agreed dismissal with prejudice, (ii) Internet protocol and security technology that resulted in an award to the client of fees and expenses; and (iii) series of lawsuits related to wireless LAN technology, all of which were resolved through judgments of non-infringement affirmed by the Federal Circuit, or settlements advantageous to the clients.
Represented three major mobile network operators (MNOs) in numerous patent litigation matters related to (i) multi-access network topologies, (ii) UMA networks, (iii) electronic billing systems, and (iv) Voice over Internet Protocol (VoIP) technology that resulted in voluntary dismissals of the plaintiffs’ claims, dismissal of claims due to license (affirmed by the Federal Circuit), or settlements advantageous to the clients.
Represented a digital watermarking company in patent litigation matter that resulted in the plaintiff voluntarily dismissing its claims.
Represented Internet security provider in patent litigation matter involving distributed security service management that resulted in settlement that the client found advantageous.
Represented Fortune 500 hotel company in defense of numerous patent infringement matters including one that was dismissed without any payment by the client.
Represented a major Wisconsin paper and packaging company in a patent infringement matter that resulted in the company's competitor being enjoined from sales of infringing packaging products.
Represented a healthcare products distributor in the successful pursuit of multiple claims for false advertising, theft of trade secrets and trademark infringement.
Represented Fortune 500 document management company in successful pursuit of injunction against a distributor of gray market goods.
Represented leading manufacturer of kamado-style grills in enforcement of patent portfolio.
Represent multiple privately held healthcare companies with respect to trademark portfolio management, defense of trademark infringement claims and trademark enforcement.
