Andrew John (AJ) Rudowitz is a member of the Trial Practice Group, focusing his practice on advising clients in the areas of complex commercial disputes, antitrust and competition litigation, white-collar criminal defense, non-compete/trade secrets and False Claims Act cases. Mr. Rudowitz has represented clients in the Sports and Athletics industry, as well as in all areas of the Healthcare industry, including Hospitals, Providers, Pharmaceutical Manufacturers, and Medical Device Manufacturers, as well as clients in the Telecommunications, Transportation and Construction industries.

Mr. Rudowitz has represented companies and individuals in adverse actions with state and federal governments, including administrative, civil and criminal matters, with the FTC, DOJ, OIG, and CMS, among other agencies.  Mr. Rudowitz has assisted clients, both within and outside the Healthcare industry, in successfully navigating and defending themselves against disputes involving complex statutory schemes, including federal and state antitrust laws, the False Claims Act, the Stark Law, and the Anti-Kickback Statute.

Mr. Rudowitz has significant experience in conducting internal investigations for higher education institutions and other organizations, and has utilized his background as a former collegiate and professional basketball player in successfully representing various stakeholders in the industry, including professional athletes and coaches, NIL agencies, universities, and athletes.  Prior to entering law school, Mr. Rudowitz was a professional basketball player in Germany for four years, and is proficient in written and spoken German.

Mr. Rudowitz participates in the firm’s robust Pro Bono Program in the areas of Veterans’ Rights and Juvenile Lifers Without Parole.

Mr. Rudowitz is a 2017 summa cum laude graduate of Temple University, Beasley School of Law, where he was Articles Editor of the Temple Law Review. Mr. Rudowitz graduated from Stonehill College in 2010, with a degree in Business Management. While in law school, Mr. Rudowitz served as a judicial intern for the Honorable Juan Sánchez of the U.S. District Court for the Eastern District of Pennsylvania.

 

 

Representative Matters

  • Represented a candy manufacturer in consumer class action related to product recall. Obtained early favorable resolution for client.

  • Represented former professional football player in successfully obtaining summary judgment on all claims, and awarded punitive damages.

  • Represented minority owners of urgent care business in action against majority owner on claims of fraud and embezzlement.

  • Represented pharmaceutical manufacturer in three-day arbitration hearing concerning misrepresentations in the sale of a manufacturing plant.

  • Represented clean energy innovator and manufacturer in two-day arbitration hearing concerning dispute over exclusivity to a technology.

  • Represented Virtua Health System and Our Lady of Lourdes Health System in commercial litigation brought by Deborah Heart & Lung Center in New Jersey state court whereby Deborah claimed that Virtua’s acquisition of Lourdes in 2019 caused Lourdes to breach a restrictive covenant in a contract between Deborah and Lourdes, and resulted in Virtua inducing the alleged breach and competing unfairly with Deborah. This matter was resolved by the mutual agreement of the parties and dismissed in its entirety with prejudice.

  • Representing former pharmaceutical executive Martin Shkreli in defending against allegations of monopoly maintenance and anticompetitive conduct under the Sherman Act, in Federal Trade Commission, et al. v. Vyera Pharmaceuticals LLC, et al. (S.D.N.Y).

  • Defended generic pharmaceutical supplier in multidistrict price-fixing cases.

  • Represented the President of an information technology staffing firm in criminal prosecution for visa fraud and criminal forfeiture.

  • Represented Otto Bock HealthCare North America, Inc. in FTC investigation and litigation. FTC Docket No. 9378

  • Successfully represented a U.S. company in an eighteen (18) month hearing before the Pennsylvania Gaming Control Board involving complicated legal issues under the Pennsylvania gaming law, comparison of the regulation of a licensee in Hong Kong with the regulation of a registered investment adviser in the United States, as well as a comparison of the regulation of an investment company in the Cayman Islands with the regulation of an investment company in the United States.

  • Represented Virtus Pharmaceuticals, a specialty pharmaceutical company, in a recent mediation against a now defunct contract drug manufacturer and its insurers. Recovered all of Virtus' multi-million dollar losses resulting from a national recall of two drugs made by the manufacturer.
