Sandra A. Jeskie is an experienced litigator, arbitrator, mediator and special master to the courts in a variety of commercial business disputes and matters involving complex contractual issues, technology, software, intellectual property or information/data. Her practice of over 25 years includes commercial litigation, software litigation, privacy, information security, and information technology. Ms. Jeskie serves as a team lead for the Duane Morris Technology, Media & Telecom industry group, which includes data privacy, security and artificial intelligence/emerging technologies. She is an elected member of the American Law Institute (ALI) and served as President of the International Technology Law Association (ITechLaw). Law360 listed her as "Best-of-the-Best Attorneys" and "Cream of the Crop Litigators". Based on a client satisfaction survey of in-house counsel, BTI Consulting Group also recognized Ms. Jeskie as "delivering the absolute best client service."

Alternative Dispute Resolution. Ms. Jeskie is a seasoned arbitrator (panel chair, wing and sole arbitrator) and mediator for complex business, technology and/or intellectual property disputes. She served as arbitrator in more than 100 disputes, including numerous multi-million dollar bet-the-company matters. She also engages in Early Neutral Evaluation and serves the courts as a special master, mediator, and judge pro-tempore in complex disputes. As an author of the “Contracts” chapter in the acclaimed treatise Business and Commercial Litigation in Federal Courts, Ms. Jeskie is well equipped to handle complex contractual disputes and relying on her deep technical background, she is known for her ability to understand technical details in the most complex disputes. She has an MBA in finance and her domestic and international ADR training includes programs administered by AAA, ICDR, the Chartered Institute of Arbitrators (CIArb) and Pepperdine University’s Straus Institute for Dispute Resolution. Privacy, Data Governance and Information Security. Regularly counseling in the complex areas of data privacy and information security, Ms. Jeskie helps clients navigate compliance regulatory and industry-specific issues, including but not limited to California Consumer Privacy Act (CCPA), TCPA and other federal and state laws. She also counsels on security risk assessments, investigations, ransomware attacks and security breach response. Leveraging a highly cultivated global network, Ms. Jeskie also works with multinational companies on global privacy and security compliance. She is listed in Best Lawyers in the areas of privacy and data security law.

AI, Information Technology and Emerging Technologies. Relying on her deep technical background, with a degree in computer science and 16 years' experience as a computer scientist, Ms. Jeskie advises clients in the emerging area of artificial intelligence and on a variety of information technology matters, including big data, e-commerce, online advertising and marketing campaigns. She served as President of the International Technology Law Association (ITechLaw), taught as adjunct professor at Rutgers School of Law, recognized in the International Who's Who of Internet and e-Commerce Lawyers, appeared as a commentator on several televised programs and has often been quoted in the press.

Commercial Litigation. Ms. Jeskie has been trial counsel in a large number of complex commercial litigation, technology and IP matters. She is a co-author of chapters in the acclaimed treatise Business and Commercial Litigation in Federal Courts, and The Woman Advocate. She is also the former Chair of the Business Law Section of the Bar Association.

Software Litigation and Licensing. Building on her deep technical background in the industry, Ms. Jeskie has represented clients in complex software litigation arising from software implementation failures and licensing disputes for both software developers and customers. She was trial counsel in one of the largest software implementation disputes when she represented Lockheed Martin in an action against the New York Mass Transit Authority relating to the installation of an electronic security system. Ms. Jeskie often performs early case assessments for clients on bet the company disputes. Relying on her software background, she is known for her ability to understand and translate the technical details of complex implementations. She also works with clients to negotiate software licenses and on project management issues during on-going software implementations.

Intellectual Property and Pharmaceutical Litigation. Ms. Jeskie has been a trusted advisor to companies in the pharmaceutical and other industries where she brought together multidisciplinary teams to protect intellectual property and handle general corporate needs.

International Work. Relying on her varied experience, Ms. Jeskie has advised international companies in various aspects of their business and has taught at nearly a hundred professional education conferences in numerous cities around the United States and in fourteen countries in Europe, Asia and South America. She has also been trained as an international arbitrator by the Chartered Institute of Arbitrators (CIArb) and ICDR and is a Fellow of CIArb.

Ms. Jeskie earned her J.D. from Temple University Beasley School of Law, magna cum laude. She graduated with an M.B.A. from La Salle University, where she also earned her B.A. in computer science.

She has 16 years of experience as a computer scientist, served as President of the International Technology Law Association (ITechLaw) and has been recognized by the Silicon Valley Arbitration & Mediation Center (SVAMC) as one of the world’s leading technology arbitrators and mediators on their “Tech List.” She has experience in software, licensing, e-commerce, outsourcing, internet, telecommunications, artificial intelligence, privacy, security, ransomware, blockchain and smart contracts.

  • Accu-Time Systems, Inc. v. Zucchetti et al. - Represented defendant in a patent infringement and unjust enrichment litigation relating to a time keeping device. All claims were withdrawn after minimal discovery. (E.D. Pa.)

  • Rothman v. Mothers Work - Participated in defense of national maternity apparel company and its distributors against patent infringement claims. Negotiated settlement that client found highly favorable on eve of trial. (D.N.J.)

  • Career Network, Inc., et al. v. WOT Services, Ltd. (Ninth Judicial. Cir. Fla.) – Obtained an order from the Circuit Court of Orange County, Fla., dismissing with prejudice a suit brought against an operator of a web of trust website by a group of corporate plaintiffs based on Section 230 of the Communications Decency Act.
  • Johnson Matthey v. Research (S.D.N.Y.) - Represented plaintiff in complex pharmaceutical development, trade secret and licensing litigation. Settlement achieved that client found favorable.
  • Harold v. Pill Pockets, Inc., et al. - Represented defendants, a manufacturer and distributor of a pet related products, in defending a broad intellectual property suit brought by the prior owner of a patent. Settlement achieved that client found favorable.
  • CertainTeed v. CTA Acoustics - Represented plaintiff in trade secret and business tort litigation. Settlement achieved that client found favorable.
  • Babiarz v. Verizon - Represented Verizon in defending a broad intellectual property suit brought by an employee. Achieved dismissal of 13 causes of action on preliminary objections. (Phila. Commerce Ct.)

  • Yahoo! - Represented Yahoo! in several cases relating to ISP liability under the Communications Decency Act (CDA). Achieved a result that Yahoo! found favorable in cases, either by settlement or dismissal.

  • Freedom Medical, Inc. v. Gillespie, et al. - Represented defendant in breach of employment agreement, unfair competition and trade secret case. Achieved settlement that client found favorable. (E.D. Pa.)
  • Fifty-Six Hope Road Music, Ltd. v. Fame Jeans, et al. - Represented defendant relating to use of photographic images of Bob Marley. Achieved settlement that client found favorable.
